1. Agreement
These Terms of Use (“Terms”) are a contract between you and
Fuzhou Taijiang Kangzhixuan Technology Co., Ltd (“we”, “us”, or “our”)
for the iOS app SeloPhoto (bundle identifier com.gohealthai.seloPhoto;
Apple App Store ID 6811556061).
By downloading, installing, purchasing features in, or using SeloPhoto, you agree to these Terms and to the Privacy Policy. If you are using the app on behalf of an organization, you represent that you have authority to bind that organization.
You must be able to form a binding contract. If you are under the age of majority where you live, you may use SeloPhoto only with a parent or guardian’s permission.
2. Apple licensed application terms
SeloPhoto is a Licensed Application distributed through the Apple App Store. Apple’s Licensed Application End User License Agreement and the Apple Media Services Terms and Conditions also apply. If these Terms and Apple’s standard terms conflict on a subject Apple controls (including billing, refunds, Store availability, and family sharing), Apple’s terms control that subject.
Apple is not a party to these Terms, is not responsible for SeloPhoto, and has no obligation to provide maintenance or support for the app. Apple is a third-party beneficiary of the license Apple requires for Licensed Applications.
3. License to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use SeloPhoto on Apple-branded devices that you own or control, solely as permitted by the App Store usage rules.
You may not:
- copy, modify, or create derivative works of the app, except as allowed by law
- reverse engineer, decompile, or extract source code, except where that restriction is prohibited
- rent, sublicense, or provide the app as a hosted service
- circumvent purchase, layout, background, or export limits
- remove proprietary notices
We and our licensors retain all right, title, and interest in SeloPhoto, including layouts, presets, design, and trademarks. These Terms do not sell the app to you.
4. In-App Purchases
SeloPhoto may be used without paying for a limited set of layouts, backgrounds, and export options. A one-time In-App Purchase (“Pro”) unlocks additional layouts, custom backgrounds (including photo, color, and gradient backgrounds), and custom export size and file-size options, as shown in the app at the time of purchase.
Pro is a lifetime license for the then-current SeloPhoto iOS app on Apple platforms where we make that product available. It is not a subscription and does not automatically renew. It does not guarantee that every future feature we might later add will be free of a separate charge.
- Price and local taxes are those displayed by the App Store at checkout.
- Payment is charged to your Apple ID. We do not collect your card number.
- You can restore a purchase on devices signed in with the same Apple ID, using Restore Purchases.
- Offer codes, where Apple makes them available, are redeemed through Apple’s redemption flow.
- Refunds, billing disputes, and purchase cancellations are handled by Apple under Apple Media Services Terms. Contact Apple Support for those requests.
Purchase status is validated with Apple and RevenueCat so the app can unlock and restore Pro. See the Privacy Policy for what that involves.
5. Your photos and content
You retain all rights in photos, text, and other material you import or create in SeloPhoto (“Your Content”). We do not claim ownership of Your Content.
You grant us a limited license to process Your Content on your device solely to operate the features you use (import, edit, preview, export, and share). We do not use that license to upload your photos to servers we operate.
You represent that:
- you have the rights needed to use Your Content in the app
- Your Content does not infringe others’ intellectual-property, privacy, or publicity rights
- Your Content is not illegal in the places where you use or share it
Exporting or sharing is your act. Destinations you choose (Photos, Messages, social apps, files) are governed by those services, not by these Terms.
6. Acceptable use
You agree not to use SeloPhoto to:
- violate law, these Terms, or third-party rights
- create or share child sexual abuse material or other illegal sexual content
- harass, threaten, or exploit others
- attempt unauthorized access to our systems, Apple’s systems, or RevenueCat
- interfere with the app’s normal operation, including purchase validation
SeloPhoto is a creative layout tool. It is not designed for medical, legal, or other professional advice, and you must not rely on it as such.
7. Availability and changes
We may update, suspend, or discontinue SeloPhoto, features, layouts, or prices. We may require an app update to keep using the product. We do not promise uninterrupted or error-free operation.
A lifetime Pro license applies to SeloPhoto as we make it available. It does not require us to keep operating the app forever, to provide a specific device or OS version in perpetuity, or to offer every current layout unchanged.
StoreKit, Offer Codes, and Restore Purchases depend on Apple services and on a working network at the moment of purchase or restore.
8. Disclaimer of warranties
SeloPhoto is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement.
We do not warrant that export will match every third-party platform’s size or compression rules, that metadata will be preserved or stripped in a particular way beyond what the Privacy Policy describes, or that a collage will be accepted by any social network.
Some places do not allow certain warranty disclaimers. In those places, the disclaimer applies only to the extent permitted, and statutory consumer guarantees that cannot be excluded remain in force.
9. Limitation of liability
To the maximum extent permitted by law, we and our directors, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to SeloPhoto or these Terms, even if we have been advised of the possibility of those damages.
To the maximum extent permitted by law, our total liability for all claims relating to SeloPhoto or these Terms is limited to the amount you paid for SeloPhoto Pro. If you have not purchased Pro, that amount is zero. Amounts paid through the App Store are paid to Apple; this cap still measures our liability to you.
Nothing in these Terms excludes liability that cannot be limited under applicable law, including liability for fraud or for personal injury caused by our negligence where such exclusion is forbidden.
10. Indemnity
You will defend and indemnify us against claims, damages, and reasonable legal fees arising from Your Content, your use of SeloPhoto, or your breach of these Terms, except to the extent caused by our willful misconduct.
11. Termination
You may stop using SeloPhoto at any time by deleting the app. Your App Store purchase record remains with Apple.
We may suspend or terminate the license if you materially breach these Terms. Sections that by their nature should survive (including ownership, purchase terms already performed, disclaimers, liability limits, indemnity, and governing law) survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law rules. If a dispute cannot be resolved informally, either party may bring it before a court of competent jurisdiction in Fuzhou, Fujian, China.
If you are a consumer, you may also have mandatory protections and forum rights in your country of residence that these Terms cannot take away. App Store billing and refund disputes should be raised with Apple.
13. General
- These Terms, the Privacy Policy, and the Apple terms referenced above are the entire agreement for SeloPhoto.
- If a provision is unenforceable, the rest remains in effect.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms without our consent. We may assign them in connection with a reorganization or sale of the app.
- The English version of these Terms is the operative version.
- Headings are for convenience only.
We may update these Terms. The “Effective date” will change. If you continue to use SeloPhoto after an update, you accept the new Terms. If you do not agree, stop using the app.
